Instructors Liability

Unfortunately, in today’s litigious society,  we as instructors , like other professionals, can be subject to claims of negligence etc… That is why we recommend you use a wavier / hold harmless agreement to protect yourself as independent instructors. Using a proper wavier / hold harmless agreement is about protection – for you and your family. Each state has its own rules, and protocol, so we cannot give you legal advice, it is best to consult your own local attorney.  The Cuyamungue Institute is an educational organization only, and cannot be held responsible for how individual instructors interpret, adapt or use Ecstatic Trance Postures, the Cuyamungue Method. We can only recommend that all instruction of the Ecstatic Trance Postures be done in the way and steps specified by Dr. Goodman.  As has always been CI’s policy, instructors and participants accept that any and all classes or instruction undertaken are solely the responsibility of the user and or instructor, and that the Cuyamungue Institute will not be held responsible or liable for any reason as a result of undertaking any classes or instruction.

Although we are unaware of any reported issues stemming from the use of Ecstatic Trance Postures, there have been some situations which make the threat of liability small but nonetheless real. Still, liability concerns need not dominate, instead lets take this opportunity to balance appropriate legal protection with the ethical and spiritual commitments our practice embodies.

Here are some practical suggestions for reducing potential liability exposure while maintaining a safe and respectful teaching environment.

Wavier Agreement: Every student needs to sign prior to entering a workshop event. Every state may have different laws – here is our basic wavier agreement for a reference but do get your own legal advice.

Depending upon your circumstances and state, two considerations are liability insurance, and creating an LLC, a Limited Liability Corporation, under which to conduct workshops. There is coverage available, such as yoga teachers use. The Institute has insurance only for the Board of Directors and the Institute itself.  CI does not have coverage for instructors, whether at the institute or in the field. You are independent.

Posture Selection. The postures you select for your workshop is extremely important.  The Board of Directors can only recommend the original postures approved and specified by Dr. Goodman.
